Terms of Use
Agreement to These Terms
These Terms of Use govern your use of Now Batting. By using the app, you agree to these Terms. If you do not agree, do not use the app.
What Now Batting Does
Now Batting is a youth baseball and softball walk-up intro app. It allows users to create teams and players, generate announcer-style voice intros, choose built-in music clips, optionally import local audio files, and use game mode to play intros during games.
Who May Use the App
Now Batting is intended for parents, coaches, team organizers, and other authorized users. If you enter information about a minor, including a player name, photo, jersey number, or team information, you are responsible for confirming you have permission to do so.
Accounts
Some features may require an account. You agree to provide accurate account information and keep your login credentials secure. You are responsible for activity under your account. Now Batting may limit account access, including limiting active cloud sessions, to protect accounts and prevent misuse.
Free and Paid Features
Now Batting may offer a free preview version with limited features and paid Pro features. Paid features may include expanded team/player management, AI voice generation, cloud sync, imported audio, and other premium tools. Subscription terms and pricing will be shown before purchase.
Subscriptions and Billing
Purchases may be handled through Apple App Store billing, Google Play billing, RevenueCat, or another payment provider. By purchasing a subscription or paid feature, you agree to the billing terms shown at checkout.
Subscriptions may automatically renew unless canceled through your Apple App Store or Google Play account settings before the renewal date. Now Batting does not directly control Apple or Google billing settings.
AI Voice Generation
Now Batting may use ElevenLabs to generate announcer-style voice intros. You are responsible for reviewing generated intros before using them at games or events. AI-generated audio may occasionally mispronounce names, produce unexpected results, or require regeneration.
You may not use the app to generate hateful, harassing, obscene, abusive, deceptive, unlawful, or harmful content.
Music and Audio Rights
Now Batting may provide built-in music clips for use within the app. The app may also allow users to import local audio files.
You are solely responsible for making sure you own, have licensed, or have permission to use any audio you import. This includes any public performance rights, league permissions, venue permissions, school permissions, or event permissions that may apply.
Now Batting does not grant you rights to third-party songs, recordings, sound effects, or other audio that you import yourself. Do not upload or use audio in a way that violates copyright, trademark, publicity, privacy, or other rights.
User Content
User Content means anything you enter, upload, create, or store in the app, including team names, player names, photos, pronunciation notes, imported music, and generated intro settings. You keep ownership of your User Content.
By using the app, you give Now Batting permission to store, process, transmit, and display your User Content as needed to provide the app's features. This includes sending intro scripts to voice generation providers when you choose to generate audio. You are responsible for your User Content and for having all necessary rights and permissions to use it.
Acceptable Use
You agree not to use the app for unlawful purposes, upload content you do not have rights to use, enter private or sensitive information that is not needed for the app, harass or impersonate others, attempt to reverse engineer or disrupt the app, access another user's account or data, generate or distribute harmful content, or use the app in a way that violates league, school, venue, or event rules.
Game and Event Use
Now Batting is a tool for playing intros and audio during games or events. You are responsible for following all applicable venue, league, school, team, copyright, public performance, and sound rules. Now Batting is not responsible for how users operate speakers, audio systems, event equipment, or imported audio at games.
Offline Use
Now Batting may store certain data locally on your device so game mode can work offline. Some features require internet access, including account login, subscription verification, cloud sync, AI voice generation, uploading photos, and restoring data on a new device. We cannot guarantee that all features will work without internet access.
Account Deletion
You may request account deletion from inside the app or through our support page. Account deletion requests will be processed within 48 hours. Deleting your account may permanently remove your account data, teams, players, uploaded photos, generated audio, and related app data.
Canceling a subscription and deleting an account are separate actions. To avoid future billing, you must cancel your subscription through Apple App Store or Google Play settings.
Refunds
Refund eligibility depends on where you purchased the app or subscription. For purchases made through Apple or Google, refund requests are generally handled by Apple or Google under their own policies. See our Refund Policy for more information.
App Changes
We may update, modify, suspend, or discontinue parts of the app at any time. We may add or remove features, update pricing, change providers, or revise limitations as the app evolves.
No Guarantee of Availability
We try to keep Now Batting reliable, but we do not guarantee uninterrupted or error-free service. The app may be unavailable due to maintenance, third-party provider issues, internet problems, app store issues, or other events outside our control.
Disclaimers
Now Batting is provided "as is" and "as available." We do not guarantee that AI-generated intros will always be accurate, names will always be pronounced correctly, imported audio will always play correctly, the app will work with every speaker, device, venue, or audio setup, or the app will be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent allowed by law, Now Batting and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes lost data, lost revenue, event disruption, audio playback issues, subscription issues, or disputes related to imported audio rights.
Termination
We may suspend or terminate access to the app if we believe a user has violated these Terms, misused the app, infringed rights, created risk for others, or engaged in fraud or abuse.
Changes to These Terms
We may update these Terms from time to time. If changes are material, we may notify users through the app or by other reasonable means. Continued use of the app after changes means you accept the updated Terms.
